In the Name of Allah, the All-beneficent, the All-merciful
“Yet it is not for the faithful to go forth en masse. But why should not there a group from each of their sections go forth to become learned in religion, and to warn their people when they return to them, so that they may beware?” (Qurʾan 9:122)
On the topic of Islamic jurisprudence and the system of values according to the Marjaʿ al-Modarresi was the lecture delivered by Sayed Mahmoud Al-Mosawi at the Representative Office of the Marjaʿ al-Modarresi in Bahrain, on the eve of Wednesday 2/6/2009 CE.
.
He began by reflecting on verse 122 of Surat al-Tawba concerning the necessity of becoming learned in religion, and the verses following it, which showed that jurisprudence has dynamism and has aims, and has effects in society and is not husks. Likewise, the Marjaʿ al-Modarresi points out that every jurisprudential ruling that the Holy Qurʾan has set forth it must accompany with the purpose and aim of that ruling; and this directs us to the necessity of the presence of the aims of rulings and the wisdom of the ruling in the process of deduction and in the process of compliance, so that rulings are not emptied of their content and their message.
He then mentioned that the science of jurisprudence has been approached in different forms and methods from one time to another, and scholars have had developmental contributions, among them the contribution of the Marjaʿ al-Modarresi in the aspect of values, where he establishes a pyramid of values founded on the verses of the Holy Qurʾan and the narrations of the Prophet and his Ahl al-Bayt; then the legal rulings revolve around those values, being details and instances drawn from that value.
He gave as an example of this the value of peace and how it branches into all the fields of life in the form of legal rulings: as in the greeting among believers, the peace of homes in the family aspect, and a social attribute that governs people's relations with one another; it is a lofty goal that believers must spread and work for, and consequently it will encompass the nature of rulings in politics, economics and other fields..
